General Terms and Conditions (GTC)


1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers and businesses via the Amaru Labs online shop (Luzernerstraße 8, 16341 Panketal, email: support@amarulabs.com).

A consumer is any natural person who enters into a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity. An entrepreneur is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.


2. Contracting parties, conclusion of contract

The purchase contract is concluded with Amaru Labs (Luzernerstraße 8, 16341 Panketal).

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to order. By clicking the "Buy now" button, you place a binding order for the goods in your shopping cart. Confirmation of receipt of your order will be sent by email immediately after you submit the order. With this email confirmation, we accept your offer.


3. Prices and payment terms

All prices include VAT and exclude shipping costs, if applicable. The applicable shipping costs will be shown separately during the ordering process.

The purchase price is due immediately after conclusion of the contract.


Late payment interest and reminder fees: If the customer defaults on a payment, the amount due will be subject to interest at a rate of 5 percentage points above the base interest rate during the period of default. We reserve the right to prove higher damages caused by the default. We may charge a reminder fee of €5 for each reminder sent after the default has occurred.


4. Delivery and retention of title

Delivery takes place within Germany and, if applicable, to other countries, provided this is expressly stated in the online shop.

Retention of title: The goods remain our property until all claims arising from the current business relationship have been paid in full.

Should an ordered product be unavailable, we reserve the right not to deliver. In such a case, we will notify you immediately and promptly refund any payments already received.


5. Right of withdrawal

Consumers have a statutory right of withdrawal. Details about the right of withdrawal can be found in our cancellation policy .


6. Transport damage

If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us immediately. Failure to file a complaint or contact us will have no consequences for your statutory rights and their enforcement, in particular your warranty rights. However, you will help us assert our own claims against the freight carrier or transport insurance.


7. Warranty and guarantees

The statutory liability for defects applies.

8. Liability

We are liable without limitation for intent and gross negligence. Furthermore, we are liable for the negligent breach of obligations whose fulfillment is essential for the proper execution of the contract, whose breach jeopardizes the achievement of the contract's purpose, and on whose compliance you may regularly rely. In the latter case, however, we are only liable for foreseeable, contract-typical damages. We are not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.

The above exclusions of liability do not apply in the event of injury to life, body or health.

9. Force Majeure

We are not liable in the event that we are unable to deliver or provide our services due to force majeure (e.g., natural disasters, strikes, pandemics). In such cases, the deadline for providing our services will be extended accordingly.


10. Dispute resolution

The EU Commission provides a platform for out-of-court dispute resolution. This gives consumers the opportunity to resolve disputes related to their online orders without initially involving a court. We are prepared to participate in an out-of-court arbitration procedure before a consumer arbitration board.


11. Jurisdiction clause for entrepreneurs

For merchants, legal entities under public law or special funds under public law, Berlin shall be the exclusive place of jurisdiction.


12. Final provisions

Should individual provisions of these Terms and Conditions be invalid, the remaining provisions of the contract shall remain valid. The invalid provisions shall be replaced by the statutory provisions, where applicable.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
